Justice R Subbiah, before whom the plea came, posted the case to September 28 for final orders. Stalin in his plea had submitted that the Opposition leader is entitled to have a personal assistant and the rule prescribes  that the person appointed to the post of personal assistant shall continue till the leader of opposition vacates office or till termination by the leader of opposition himself.

He noted that based on this entitlement, M Athiseshan in the rank of Deputy Secretary was appointed as his PA by the Tamil Nadu Legislative Assembly after observing all legal and administrative formalities and obtaining financial sanction from the Finance Department.
