Corporation and cops speak in different voices on boy’s death in manhole
A piquant situation prevailed at the Madras High Court as two different stands were taken in the death of a three-year-old boy who died in 2013 after failing into a manhole.

While the Corporation dropped the proceedings against erring officials, the police has blamed it on the two officers for the boy’s death.
The Corporation in its report had submitted that there does not exist any investigation report on the death of the boy stated to have died in the storm water drain owing to a damaged manhole cover.
It further submitted that the engineer who held the investigation visited the Taramani police station and he did not find any investigation report either conducted by the department or by the police clearly holding that the death of the boy happened only through the damaged cover of the manhole and copy of such reports being given to the officials who were charged.
However, the Additional Commissioner of Police, Traffic Zone, in its affidavit submitted that during investigation it was found that G Logeswaran, Assistant Engineer and T Gopalakannan, road worker, Corporation are responsible for the death of the said boy due to their negligence of duty.
However, the petition also claimed that the case has been altered from Section 174 of CrPC, which deals with accidental death to 304(A) IPC, which deals with causing death by negligence.
