‘Set timeframe to fill judges post’
In a bid to stem the inordinate delay in filling up the vacancies of judges in the Supreme Court and High Courts, the Madras Bar Association has come out with a slew of suggestions including an amendment to the Constitution and fixing a time frame to fill the vacancies.

A memorandum, which is set to be placed before the Parliamentary Standing Committee on Law and Justice on November 2, said that a structure similar to that of setting time limits in place for filling up vacancies like President and Vice-President, wherein the vacancy caused by the expiration of the term of office shall be completed before the expiration of the term, needs to be evolved for filling up vacancies of judges.
The memorandum pointed out that if any Collegium member is unable to attend three consecutive meetings, the Collegiums should coopt the next senior most judge and transact business. This will avoid delay.
Also, seeking a time frame for every stage of judge selection process, the memorandum insisted that the selection process should be started by the HC at least nine months in advance of expected vacancy caused by retirement and names should be recommended at least seven months in advance.
The other suggestions sought the state to convey their views on the proposed names within 60 days and the Supreme Court in turn should forward their recommendation to the Centre within 60 days. The Centre should forward their recommendations to the President within 60 days and the President may issue warrants of appointment giving priority to judges’ appointment.
