Bypolls row: Case adjourned to November 14
The Madras High Court was informed on Monday that the Election Commission of India (ECI) has issued notices to both the AIADMK and DMK about the cancellation of elections in Thanjavur and Aravakuruchi, where incidents of bribing voters by candidates resulted in the action.

The first bench of comprising Chief Justice Sanjay Kishan Kaul and Justice R Mahadevan on recording the Additional Solicitor General (ASG) G Rajagopalan’s submission that the notices were issued on May 19, 2016 and that he sought time to obtain instructions based on the query as to how much time would it take to conclude the proceedings, posted the case for further hearing to November 14.
The ASG also submitted that the Supreme Court has referred to the constitutional bench the larger issue as to whether a legislator facing criminal trial should be disqualified at the very stage of framing of charges against him by the trial court or should his disqualification be kept in abeyance till he is convicted.
However, the counsel appearing on behalf of the petitioner had submitted that since the very same candidates have been nominated by the parties, the ECI should examine the question of suspension of the election symbol for the two candidates.
