The first bench comprising acting Chief Justice Huluvadi G Ramesh and Justice M Sundar before whom the PIL come up for hearing said “The writ petition is based on newspaper reports and without any other ground work. The petitioner’s grievance cannot be termed as PIL. Dismissed”.

The bench also held that “It is the submission of the Government Pleader that the state of Tamil Nadu is one of  the best States in supplying essential commodities to the poor and needy people. On hearing the learned counsels for the parties, we are of the view that the petition is bereft of material particulars or statistics.”

D Simon of Kodungaiyur, had submitted that these days none of the fair price shops distributed essentials like sugar, kerosene, palm oil and dhal apart from 10 Kgs of rice, given free of cost.

Moreover, instead of rice, poor people are given only wheat the petitioner claimed and added that besides this issue being reported in all vernacular dailies, the authorities have failed to act. He also submitted that with the entire state reeling under drought it’s the bounden duty of the State to guarantee food to ever  citizen.
