Advocate Commissioner appointed to inspect impingement by SIAA

Madras High Court has appointed an advocate commissioner to inspect the alleged encroachment of a road in T Nagar area here by Nadigar Sangam Charitable Trust and South Indian Artistes Association and file a report on it by June 2.

A vacation bench of Justices N Kirubakaran and V Parthiban passed the interim order on a petition by two residents of Vidhyodaya colony in T Nagar here, alleging encroachment of a road in their locality by Nadigar Sangam and SIAA.

"Advocate Commissioner K Elango is appointed to measure the property of Nadigar Sangam with the assistance of Assistant Director of Survey and Tahsildar, Guindy Taluk. Both the parties are directed to co-operate with the Commissioner and give complete assistance by providing all documents," it said.

"The Commissioner is at liberty to seek all the records from the revenue department and even from the Corporation of Chennai," the Bench said and posted the matter to June 2.

Meanwhile, the Sangam has also assured the court that no construction activities would be carried out in the disputed site till the issue is settled by the Court.

The petitioners submitted that the colony has two approach roads to reach Habibullah road, and one of them being the shortest, most of the residents and school going children use it to reach the locality.

However, residents and the public were now being prevented from using the road by the trust and SIAA by blocking it for constructing a building for the association, they alleged.

They further said that since Association members have influence over government authorities, they had managed to obtain patta for the encroached space in 2010 by suppressing material facts.

The association cannot be allowed to construct a multi-storied mall or multiplex theatres in the residential area, which would suffocate the already chocked roads, they added.
