Quashing the GO which allowed the State to grant weightage to government doctors working in PHCs located in rural areas and those employed in Government hospital located in TNR Districts, the division bench comprising Justice Rajiv Shakdher and Justice R Suresh Kumar held, “The merit list dated May 5, 2017, as drawn up, though, is completely flawed, is saved to the extent where weightage is granted to in-service candidates, who have worked in areas/districts in List A, B and C in Annexure VII to the prospectus dated March 27, 2017.”
The bench, while disposing of a batch of writ petitions that weightage has been given to candidates who had served in areas, which do not qualify as remote said, “There is no criteria which the State has put in place, and therefore, we have no hesitation in concluding that the entire exercise of according weightage to the in-service candidates, in terms of the proviso to Regulation 9(IV), is flawed.”
The bench also said, “Even if we were to ignore the factum of absence of criteria and accept the lists incorporated in Annexure VII to the prospectus, it is evident that only List C could have been accepted, which pertains to government hospitals under the control of DMRHS, which are, according to the State, located in remote and difficult areas.”
