Road accident victim’s kin get Rs 32 lakh relief

The Motor Accidents Claims Tribunal (MACT), Chennai, has directed the New India Assurance Company Limited to pay a compensation of Rs 32.6 lakh to the kin of a road accident victim on Chennai-Bengaluru National Highway in 2016.

The petition was filed by S Chellammal, a resident of Virudhunagar, under Section 166 of Motor Vehicles Act and Rule 3 of MACT claiming a compensation of Rs 50 lakh for the death S Srinivasan.

According to the petition, S Srinivasan (30), a priest, was on the way to Bengaluru from Chennai on May 8, 2016, in a car, when he met with the fatal accident. The driver drove in a rash and negligent manner and lost control of the vehicle and the car turned upside down near SN Palayam in Vellore district. Eventually, Srinivasan was taken to a hospital and died without responding to the treatment on May 15. “The driver of the car and the insurance firm, being the insurer of the vehicle, are jointly liable to pay compensation for the death of Srinivasan,” the petition read.

Countering this, the insurance firm denied the allegations and said the compensation claimed under various categories is too high. Recording the submissions, judge M Sivasakthi said, “It is established that the accident had occurred only due to the driver who drove in a rash and negligent manner. Being the insurer of the car, the firm is directed to pay Rs 32.60,800 with 7.5 per cent interest rate from the date of filing the petition.”

Further, the judge directed the firm to deposit the amount within two months towards the tribunal’s bank account.
