Supreme Court stays notice against retired judge over PETA award

The Supreme Court on Monday stayed the issuance of notice by a lower court to retired judge of the apex court justice K S Radhakrishnan in a case related to his 2014 judgment banning the bull fighting sport of jallikattu.

Justice (retd) Radhakrishnan had received an award from the People for Ethical Treatment of Animals (PETA), to which Salai Chakrapani had approached the Madurai bench of the Madras High Court.

The retired judge had moved the apex court to stay the notice and the proceedings in the case. The Madras High Court had issued notice to Justice Radhakrishnan, on a petition that the former judge be directed to return the award bestowed on him by the animal rights organisation. 

The High Court bench of Justices A Selvam and P Kalaiyarasan issued notice to Justice Radhakrishnan on a petition filed by Chakrapani. Chakrapani submitted that Justice Radhakrishnan should not have received an award from PETA, which is against jallikattu, as it was one of the parties to the case before the Supreme Court. The petitioner contended that accepting an award from the animal rights body was evidence of bias on the part of the judge.
