Plea to provide 4% quota for differently-abled in teacher posts

The Madras High Court has ordered notice to the government on a plea seeking to quash the notification issued by the Teachers Recruitment Board for the direct recruitment of Post Graduate Assistant/Physical Education Directors in school education and other departments for the year 2016-17 and instead issue a fresh notification providing four per cent reservation for differently abled candidates.

The vacation division bench comprising Justice MM Sundresh and Justice R Mahadevan on issuing notice, posted the case for further hearing to June 2. 

Tamil Nadu Association for the Rights of All Types of Differently-Abled and Caregivers (TARATDAC) submitted that section 34 of the Rights of Persons with Disabilities Act provided for four per cent reservation for those with disabilities. 

The plea also noted that the government besides issuing a fresh notification including four per cent reservation should form a new roster to that effect and remove the restriction imposed upon the persons with disabilities under the category such as one arm (OA), one leg (OL) and both legs (BL) and those suffering with 40 per cent to 70 per cent shall alone apply leaving out persons with 70 per cent to 100 per cent disabilities. This, the plea claimed was against the GO issued on March 2, 2016, by the Welfare of Differently-Abled Persons Department.
