Poll case against Jaya last to be disposed of by Supreme Court

In what has turned out to be the last case pending against former CM J Jayalalithaa since 2013 in the SC, a bench comprising Chief Justice of India JS Khehar and Justice DY Chandrachud on Monday disposed it of as infructuous after taking note of her death.

The case pertains to the 2001 Tamil Nadu Assembly polls, wherein Jayalalithaa had filed nominations from four segments. Following this, in 2007, the Madras High Court (MHC) had held that such a move was in violation of the Representation of People Act. 

Though she was not a respondent in the case, she assailed the judgement before SC that the petitioner CK Kuppuswamy, then a DMK MP, had no locus standi. It was reverted to MHC. But as Kuppuswamy died, another DMK MP Vijayan impleaded. But on its dismissal in 2013 that the case stood abated following Kuppuswamy’s death, he moved the SC. Since then, the plea has been pending.
