Will ascertain maintainability of plea against CM: Madras HC

Activist Traffic Ramaswamy has filed a petition in the Madurai Bench of the Madras High Court seeking disqualification or suspension of Chief Minister Edappadi K Palaniswami and two other ministers C Vijaya Baskar and R Kamaraj. The court on Monday said that it would assess the maintainability of the petition.

Traffic Ramaswamy, in his PIL, had stated that in the RK Nagar by-poll, Minister Vijaya Baskar was charged with distributing money to the voters.

Following the charges, sleuths attached to the Enforcement Directorate and Income Tax carried out

search operations on the residence and premises of Vijaya Baskar and many documents pertaining to the distribution of cash were recovered.

In the seized documents, the name of Palaniswami was also found and hence the Enforcement Directorate had booked cases against both Palaniswami and Vijaya Baskar.

Similarly, based on the directions from the Supreme Court, Mannargudi police have booked a case against Kamaraj under section 420 of the IPC in connection with a cheating case.

Though he had petitioned the Governor to either disqualify or to suspend them no action was taken against the trio. So, the court should direct the Governor to either disqualify or suspend the three persons, prayed Ramasamy.

When the petition was heard by justices KK Sasidharan and GR Swaminathan, they said that the maintainability of the petition would be first assessed and then the direction would be given. The case has been adjounred to Tuesday.
