Nalini in her rejoinder, on referring to the averment made by the state government in its counter affidavit that in the event of grant of parole that she may escape from lawful custody, said that the government has ignored the fact that she is a citizen of India and that she had been suffering long imprisonment even though she had become eligible for release more than a decade ago.
She further submitted that the state government had as early as in February 2014 decided to release her from prison.
As the said decision was stayed by the Supreme Court, she had not been released from prison even though she had become eligible for release under various schemes of premature release of life convicts framed by the Tamil Nadu government.
Also, on pointing out that only owing to the pendency of the writ petition before the Supreme Court, she continues to suffer as a life convict, she said if at all anything happened in prison after February 2014 as alleged by the Tamil Nadu government, the happenings should not come in the way of grant of parole to arrange for her daughter’s marriage, she said.
Citing the grant of parole to a co-life convict AG Perarivalan for two months, Nalini said, “Unless I am granted a minimum period of six months by way of parole or ordinary leave, I would not be able to make arrangements for the marriage of my daughter, who is at present living in the United Kingdom.”
