Chief Justice recuses from hearing plea seeking to recall Bedi
The first bench of the Madras High Court headed by Chief Justice Indira Banerjee recused itself from hearing a Public Interest Litigation (PIL) seeking the recall of Kiran Bedi as Lieutenant Governor of Puducherry and posted the case before another division bench.

When the plea moved by T Murugan, state committee member, Communist Party of India (CPI), Puducherry, in this regard came up on Friday, the Chief Justice observed that occasions may arise, when she may be in frequent touch with the Lt. Governor in Raj Bhavan in her official capacity as Chief Justice and hence it may not be proper to hear the petition.
Recusing herself from hearing the petition, the Chief Justice then posted the matter before the division bench comprising Justice CT Selvam and Justice N Sathishkumar.
The petitioner in his plea alleged that from the date of assumption of office as Lieutenant Governor of the Union Territory, Kiran Bedi had never respected the Constitution of India by recognition of separation of powers and the procedures prescribed under the Constitution.
Referring to various instances, the petitioner said that besides violation of constitution becoming an everyday affair, she interfered with the judiciary, legislative and executive power. He prayed the court for a direction to the Union Home Ministry to recall her.
