Party’s joint coordinator Edappadi K Palaniswami also wanted the court to order Rs 25 lakh as damages on Dinakaran for exploiting the AIADMK’s goodwill.
Allowing the application, Justice CV Karthikeyan directed the party to issue notices of the suit in English and a regional daily and posted it for hearing on March 20.
Palaniswami had submitted that the ‘Two Leaves’ and the tri-colour flag are the identities of AIADMK members for over 45 years. The colour combination (red, white and black) credit a unique identity for the members, which is in use by the party since 1972 and it has become synonymous with the AIADMK.
Further claiming that Dinakaran was an erstwhile member of the party, the petitioner said that he was never re-introduced into the party and has no right to use its flag.
Also, pointing out that the Delhi High Court has only permitted him to use ‘pressure cooker’ symbol and not the AIADMK’s name or flag, Palaniswamy contended that Dinakaran on the other hand intends to misuse the AIADMK’s flag to deceive the public.
