Government to cancel GO that stalled teachers’ appointment

A day after the High Court slammed Government officials for their failure in implementing court orders, all the officials including the Secretary, Higher Education, who were summoned, appeared before it and agreed to implement the court direction in the appointment of PG teachers.

When the matter was taken up on Friday, Sunil Paliwal, Secretary, Higher Education Department, submitted in a sworn affidavit that the government has taken a decision to amend the GO dated January 5, 2016, to the effect that in so far as orders issue treating BEd of Vinayaka Mission University as not equivalent to BEd of Tamil Nadu Teachers Education University be cancelled. The amendment had also sought to request the Tamil Nadu Public Service Commission to cancel the resolution passed in respect of non-equivalence of the above degree courses. But, while the additional advocate general Naramadha Sampath sought time to facilitate Government action in amending the GO and issue appointment orders to the selected candidates, Senior Counsel Nalini Chidambaram and advocate RN Amarnath appearing for the petitioners opposed such a request stating that the order has been passed in November 2017 and the Government is only buying time for some other extraneous considerations. 

Justice N Kirubakaran, on not being satisfied with the reasons stated in the affidavit, held, “It is seen that there is no necessity to amend the GO. If a decision has been taken to amend the GO, the Government is at liberty to do the same. However, the amendment cannot stand in the way of issuing appointment orders to the petitioners.” 

Justice Kirubakaran on granting time as sought, directed the State to issue the appointment orders and produce the same before the court on April 19, when the case would be taken up for hearing next.
