Notify final revision to check false accident claims: HC

The Madras High Court, in a bid to eradicate false accident claims cases, has directed Transport authorities to place draft rules in public domain giving 30 days’ time for response from the public and after considering the suggestions received, notify the final amendment, expeditiously.

In continuation of the expert body appointed to go into multiple accident claims involving lawyers and touts, Justice PN Prakash passed the direction after recording the submission made by the Additional Advocate General (AAG) C Emalias seeking further time to file a status report in this regard. He also added that the draft amendment to the Tamil Nadu Motor Vehicle Accident Claims Tribunal Rules, 1989 requires to be placed in public domain for suggestions before they are notified.


Also, on recording the submission made by the AAG that the Director General of Police has issued a circular incorporating directions issued by this court and police officers have been warned of disciplinary action in the event of their failure to upload the relevant documents qua vehicular accidents in Crime and Criminal Tracking Network & Systems (CCTNS) platform, Justice Prakash directed the DGP to notify the name of the nodal officer in each district in the State, together with the email ID of his office, to deal with the complaints of claimants with regard to non-uploading of relevant documents relating to vehicular accidents in the website for immediate redressal.


During the hearing, attention was drawn to the District Crime Branch, Vellore registering a case in connection with six MCOP cases on the file of the Motor Accident Claims Tribunal, Vellore, where it is alleged that fabricated medical records have been filed. “If, during investigation, involvement of advocates, medical practitioners and insurance officials come to light, the police shall proceed with the investigation and take it to its logical conclusion.” Justice Prakash added.
