Advocate General Vijay Narayan appearing on behalf of the State informed a division bench comprising Justice S Manikumar and Justice Subramonium Prasad that enumeration process to identify such poor families has also been given up. Based on this, the bench posted the plea for further hearing to after the completion of the election process.
Earlier, the bench had dismissed a couple of petitions challenging the methodology adopted by the State in fixing the beneficiaries. It held that the courts cannot sit as an appellate authority over the policy of the State, unless the same is arbitrary that it should be struck down.
However, the bench had kept the petitions pending owing to a controversy that had risen over the GO submitted by one of the petitioners. While the GO submitted by the petitioner stated that the scheme is confined only to BPL families while the other said to be the original had said that the scheme was not limited to BPL families.
This led to the Advocate General seeking action against the petitioners for providing false information to the Court based on an ungenuine GO
Following this, the bench had sought to know as to how the petitioner had got hold of the GO, which was not final. For now, the petitioner has submitted that the official concerned had released boththe GOs.
