The judges also enquired the woman about the facilities made available to her and whether the government was taking care of her. They noted that the woman submitted that she is a commerce graduate, qualified in English typewriting. “Therefore, it is expected that a job in tune with her educational as well as technical qualification should be provided by the government,” the bench added.
The woman had moved the court alleging that her husband was neither showing any interest towards her nor was he allowing their elder daughter to see her for two months. The husband suspected that allowing the daughter to be with the victim might pass on the infection to the child, the bench noted, and added: “It shows that the husband of the victim also needs to be given counselling."
The division bench comprising Justice N Kirubakaran and Justice SS Sundar also noted that the woman has gone into depression after being separated from her elder daughter for the past two months who she was fond of, and directed that the husband and daughter must be produced before the court on March 27.
"Since the husband of the victim is not looking after her and is not showing any interest to live with her, it is appropriate for the government to provide a house, a permanent government job, compensation for the mental agony and suffering she is undergoing," the bench said, adding that she should be provided a monthly payment, along with medicines, till a government job is provided to her.
She stated that while transfusing blood in December 2018, by mistake HIV infected blood was transfused to her. The bench had taken up the case as a suo motu writ petition while hearing a plea that sought to monitor blood banks and remove persons who are not qualified.
