Telecom, ISP Secys rapped for not replying to summons

Noting how women and children were threatened and blackmailed through cyberspace, a division bench comprising Justice N Kirubakaran and Justice SS Sundar had directed the telecom secretary and the ISP official, and also the national and State commissions for the protection of child rights, to file a counter after taking judicial notice of spurt in cybercrimes against children and women.

Children and women were more vulnerable in cyberspace and should be sensitised about the merits and evils of cyberspace, the bench had held while noting that awareness as well as parental window was the most important remedy as the petitioner had sought for.


The bench in its order also noted that though the Secretary of Telecommunication has issued a circular dated March 27, 2017, calling upon the Internet Service Providers (ISP) to spread awareness among their subscribers about the use of ‘parental control filters’ in the end user machines through messages of e-mail, SMS, websites, etc. But it is not known whether it has been complied with, the bench added.


The bench also suo motu impleaded the Union secretaries of the Information and Broadcasting, Home Affairs ministries, and Information and Public Relations Department of the Tamil Nadu government as respondents in the case.


The petitioner had sought for a direction to the Centre to invoke the powers vested with them under the Section 13(1) ( c ) and (J) of the National Commission for Protection of Child Rights Act and direct the ISP companies to provide ‘parental window’ service as stipulated by the Commission. The plea had also sought to prosecute ISP companies failing to provide such ‘parental window’ before the concerned magistrate.
