‘Dispose NTADCL plea by June 1’
The Madras High Court has directed the Union Ministry of Corporate Affairs (MCA) to consider the petition filed by New Tirupur Development Corporation Limited (NTADCL) urging it to not initiate any action consequent to the ministry’s notification introducing the Company (Incorporation) Amendment Rules, 2019 and dispose the same on merits and in accordance with law before June 1.

The petition sought for an interim injunction restraining the MCA and the Registrar of Companies, Coimbatore, their men and agents or any one acting for them or on their behalf, from initiating action or proceedings against NTADCL and its directors for non-filing of INC 22A-Active.
Also, in a miscellaneous petition filed, NTADCL had sought for an interim injunction restraining both the MCA and the Registrar of Companies, Coimbatore from blocking its Director Identification Numbers (DINs). The bench in its order also recorded that though the petitioner has sought for a larger prayer, senior counsel P H Arvind Pandian submitted that it was suffice to direct that the representation be considered before June 1, 2019. It may be noted that the government has made it mandatory for over 12 lakh active registered companies in India to upload all their particulars, including details of registered offices, inan e-filing.
