A division bench comprising Justice M M Sundresh and Justice Krishnan Ramasamy before whom the arguments transpired on Wednesday adjourned the plea to March 17.
State Public Prosecutor A Natarajan making submissions on behalf of the police informed the court that all action has been taken in earnest to ensure that the rights of the protestors and public are protected and that the law and order situation had not been affected owing to the protests.
Owing to a string of PILs moved for and against such anti-CAA protest, the bench had decided to hear both the sides to arrive at a comprehensive view of the protests and how it has thrown normal life out of gear. The bench had also kept its earlier order directing to arrest those involving in protests in abeyance owing to this. But when the hearing commenced a chaotic situation prevailed with the counsels for the petitioner’s started speaking at the top of their voice claiming that protests without police permission is illegal and that the police were merely requesting the protestors to disperse without initiating action. At one stage, with the situation turning chaotic with the counsels’ present thee screaming at the top of their voice about police inaction, the bench led by Justice Sundresh had to remind the counsels of court decorum and that it would provide ample time to all parties to put forth their case.
Following this, senior counsel S Prabakaran commenced his argument on behalf of the petitioner from Tirupur saying that a person’s liberty ends where another man’s nose begins and hence the right to protest should not interfere with others right of free movement. Earlier, senior counsel Vaigai raised the aspect of maintainability of such a plea through a PIL.
