M Karunanidhi’s daughter gets relief in land case

Justice T P Selvam on hearing a revision plea moved by Selvi held that there remains no evidence against her in the case. Selvi had contended that documents collected by the investigation agency and filed by the lower court does not prove her involvement since none of the documents produced before the court bears her signature.
She had also submitted that persons approaching the court of law should be with clean recard and in this case it is prima facie evident from the materials placed before the lower court, that the complainant had initiated the proceedings for extortion of more money.
V Nedumaran, complainant of the criminal case, had claimed that Selvi and her husband VM Jyothimani had cheated him to the tune of Rs 3.50 crore after promising to sell him 2.94 acres of land worth Rs 5.14 crore, in Thalambur village, near Chennai.
“Claiming to be the power agents of the property, the duo took Rs 3.50 crores as advance from me, but later refused to sell the property nor return the advance,” Nedumaran said.
Housewife allowed to manage assets
The HC has come to the rescue of a woman whose husband is in coma. The woman has been appointed as the guardian of her husband to allow her to manage and sell his immobile properties in a bid to take care of him. Justice M M Sundaresh on disposing the plea held that though there remains no provision in either the Mental Health Act or under the Guardian and Wards Act 1890 for appointment of a guardian, the court is inclined to offer relief to the woman based on the urgency expressed by the Thasildar in his report.
It may be noted that such a plea is usually filed at the Jurisdictional Civil Court by way of common law remedy. Sairabanu Mohammed Rafi of Mayiladuthurai had contended the husband is in a state of coma and is mentally and physically incapacitated. She also submitted that she had to sell the immobile properties in her hunsband’s name to take care of him.
The judge while passing the order had relied on the report submitted by Thasildar, Mayiladuthurai on the health status of the woman’s husband Mohammed Rafi.
