The first bench comprising Chief Justice Sanjay Kishan Kaul and Justice R Mahadevan on directing CMDA to file a status report in this regard as well as organising the various aspects proposed by the Court appointed local commissioner, said “If the division is carried out, each area can be administered better and an administrative in-charge can be appointed in each of the areas, who in turn can report to separate committees.”

“However, the committees, should not be jumbo ones which hardly meet or do any work” the bench added. The bench noting that there appears to be no time regulations for operation of the market, said “Time period should be specified for different activities so that the market can be maintained at other times.”

Directing to put into operation the now modernised bio-methanation plant, the judges sought stringent action against persons who dump garbage in unspecified areas.

Similarly, on noting that loaded trucks park inside the market and sell produce which is not permissible, the bench said “the operation should be restricted to the shops or other managed areas and discipline in the market should be strictly enforced.”

Further, impleading the CoP as a respondent in the case, the bench directed the reopening of the police station in the area, which had been closed, within three months for proper regulation of the market.
