State justifies suspension of DMK MLAs
The state government has informed the Madras High Court that the en masse suspension of 79 MLAS from the Legislative Assembly was justified and was in consonance with the provisions of the Constitution of India and the Tamil Nadu State Legislative Assembly Rules.

When the PIL challenging the en masse suspension of the opposition DMK MLA’s came up before the first bench, the assembly secretary in his counter submitted that the Assembly is best suited to be Judge in the matter of conduct of its proceedings and utilise the legislature powers to punish the members for their disorderly conduct in the House.
The counter also contended that Rule 121 of the TN Legislative Assembly Rules clearly states that a member who disregards the authority of the chair or abuses the rules of the House by persistently and wilfully obstructing the business of the house can be suspended for a period not exceeding the remainder of the session on a resolution being passed in the House. The DMK members were suspended as per the resolution passed under the above rule, the counter said. The case has been adjourned for further hearing to December 09.
