Madras High Court gives minor relief for pre-2011 teachers from TET

In a big relief to teachers who were recruited before November 15, 2011, the Madras High Court has directed the State government not to insist on them clearing the Teacher Eligibility Test (TET) scheduled to be held on April 29 and 30 and seek an undertaking that they would quit if they fail to clear the exam.

Justice T Raja while offering relief to the three teachers who had moved the plea challenging circular dated March 1, 2017 seeking them to take the test, pointed out that a division bench of the High Court on January 24 this year had held that that TET would be mandatory only for those who were appointed after November 2011. 

Also, recording additional government pleader P Sanjay Gandhi’s submission that education department would not forcibly obtain any undertaking from the petitioners to take up TET, the judge said, “It is made clear that authorities shall not compel the petitioners to appear for TET. There shall be an order of interim stay of the impugned communication dated March 1, 2017 sent by director of school education.” The case was posted for further hearing on April 18.
