Temporary relief for actress Kajal

The Madras High Court in an interim order has stayed the order of single judge dismissing the civil suit filed by actress Kajal Aggarwal claiming damages from VVD & Sons, a coconut oil manufacturer.

A division bench comprising justice Rajiv Shakder and justice N Sathishkumar before whom Kajal’s appeal to restrain VVD from utilising her profile came up said “In spite of the notice given to respondent he had not chosen to appear. 

Interim injunction granted till disposal of original side appeal.” The single judge had dismissed her civil suit claiming damages of Rs.2.50 crore from VVD stating that the firm had violated the norms of agreement entered into between them for the purpose of marketing and promoting their products, particularly coconut oil. 

She had contended that single judge dismissed the suit not based on law and facts of the case. She said the single judge had concentrated only on one perception that there is a dispute about the copy rights of the parties involved in the case without understanding the privity of contract.
