Originally, on a petition filed by DMK Organisation secretary RS Bharathi to purify the voters' list in RK Nagar, the first bench headed by Chief Justice Indira Banerjee on recording the ECI submissions that the names of 45,819 voters pertaining to double entry, dead voters and those who had migrated had been deleted, directed the ECI to conduct the bypoll by December 31. The bench had also directed the ECI to upload the purified voters list online.

However, submitting CDs of bogus voters, senior counsel P Wilson appearing on behalf of the DMK alleged that 5,117 bogus voters were yet to be deleted from the voters' list.

Amid heated arguments with ECI’s counsel Niranjan Rajagopalan submitting that no changes can be made to the voters' list after the election has been notified, the division bench comprising Justices T S Sivagnanam and K Ravichandrabaabu directed the ECI to file a counter and posted the case to December 11 for further hearing.
