A division bench of Justice TS Sivagnanam and Justice K Ravichandrabaabu on vacating the partial stay, allowed TRB to fill the reserved posts.
The court on June 7, had stayed the recruitment process while admitting a PIL seeking to provide 4 per cent reservation to persons with disabilities in recruitments made by the TRB, as mandated by the Rights of Persons with Disabilities Act, 2016.
Two months after the stay on August 9, the court partly vacated the stay and allowed the TRB to fill up the vacancies after holding back 4 per cent (meant for physically challenged persons) of the posts, till further orders. According to the petitioner, the determination of eligibility for the posts as per degree of disability for different categories has not been done in a rational and scientific manner by the board.
Following this, the court had then directed TRB to come up with rational criteria for physically challenged persons.
