Revive plea against Jaya memorial: Traffic Ramaswamy

Besides several mentions made before the Chief Justice VK Tahilramani on the first day of her sitting on Monday, social activist ‘Traffic’ Ramaswamy informed the first bench led by the Chief Justice about his plea pertaining to burial of former chief minister J Jayalalithaa on the Marina beach being forcibly dismissed without even being heard.

However, the Chief Justice on hearing him, sought him to approach the registry and resolve the issue.

Ramaswamy had filed a public interest litigation challenging the construction of a memorial for the former chief minister Jayalalithaa citing Coastal Regulation Zone (CRZ) violations. Besides the violation, he had also submitted that since late Jayalalithaa was convicted in a case and her co-accused are in prison, the government can’t afford to build a memorial for her using tax payer’s money. He had also sought for the relocation of the memorials built for former CMs Annadurai and MGR.

However, prior to the hearing on August 7, following the government’s refusal to allot place for the burial of DMK president and former chief minister late M Karunanidhi citing pending litigations on burials on Marina, as many as five petitions moved against the installation of Jayalalithaa’s memorial was withdrawn.

But when the bench comprising acting Chief Justice Huluvadi G Ramesh and Justice SS Sundar were passing orders on the withdrawal of the petitions, Ramaswamy’s counsel resisted the move and sought time to get instructions. But the bench based on the memo submitted by his counsel that they had no objections in late Karunanidhi being buried at Marina, the plea was dismissed as withdrawn. But now, Ramaswamy has sought for the revival of his plea as it was dismissed without him being heard.
