According to the petition, Arukani’s husband Arukutty had lodged a complaint against two persons for cheating on November 1, 2012. Arukutty had bought a lorry with the help of one Krishnankutty under a hire purchase agreement with Execudos Finance in Coimbatore.
Later, Krishnankutty and one Kanagaraj had approached Arukutty and showed a willingness to run the lorry and promised to pay the monthly instalments to the finance company. Further, they agreed to maintain the lorry and share the profits.
The petition alleged that Arukutty, without executing any documentary evidence or contract, handed over the lorry. But the duo failed to keep their end of the bargain and left Arukutty in a lurch.
He then filed a police complaint and after inquiry, the officers informed him that Krishnankutty was untraceable and they would take action to recover the lorry once he was traced.
When Arukutty couldn’t pay back the finance company, the firm issued him a legal notice, which led him into depression and ending his life. The petitioner alleged that the police officer failed to take action against the accused even after Arukutty’s suicide note named them. Countering this, two inspectors and one sub-inspector who served at various points of time denied the allegations.
Awarding the compensation to Arukani, SHRC Member A Chittaranjan Mohandoss said, “Shoddy treatment of the suicide case and dereliction of duty in not initiating a proper investigation is a breach in bringing justice.”
