Wireman’s kin awarded Rs 48L compensation

The Motor Accident Claims Tribunal has directed the TATA AIG General Insurance to pay compensation of Rs 48 lakh to the kin of a 40-year-old man who died in the road accident near Mambakkam in 2019.

R Ravi, a wireman with Tamil Nadu General and Distribution Ltd, was rammed by a motorcycle driven by its driver in a rash and negligent manner. He was walking towards Kelambakkam Road from Vandalur when the accident occurred on February 14, 2019. Ravi sustained multiple injuries in the accident and later died in the hospital.

The petition was filed by the deceased wife R Dhanam and his two minor children under section 166 of Motor Vehicle Act and Rule 3 of MACT claiming compensation of Rs 90 lakh.

According to the petition, the deceased Ravi was hit by the motorcycle from behind when he was proceeding near Mambakkam around 8.45 PM on the said day. R Dhanam submitted that his husband was the only breadwinner of the family and they were depending on his income.

The insurance firm denied the manner of the accident and said it occurred due to the fault of the deceased. “The compensation claimed by the petitioners are fanciful, exaggerated and arbitrary and the firm is not liable to pay any amount,” said the firm.

Chief Judge of Court of Small Causes, B Sarodjiny Devy, said, “It is clear the accident was occurred due to a rash and negligent act of the two-wheeler. Accordingly, being an insurer of the vehicle, the insurance firm shall have to pay the compensation.”
