Petitioner Murugesan from Thuvakudi in Tiruchy district, said that people of Devendra Kula Vellalar community consider Immanuvel Sekaran as the representative of their community. He was born on October 9,1924, and he participated in the Quit India Movement. However, he was murdered on September 11,1957. Every year, on his birthday, leaders and people across the state visit his memorial and pay respects to him.

When the birthdays of other freedom fighters were celebrated as government function, the birthday of freedom fighter Immanuvel Sekaran should also be celebrated as a government function, the petitioner prayed.

In an earlier hearing, the Court directed the state to file a counter by Tuesday. As the state failed to file a counter affidavit, the judges ordered it to consider the plea within four weeks.
