Poll plea against TTV dismissed as withdrawn

Even as the Election Commission has cancelled the by-election to the RK Nagar, the Madras High Court on Monday dismissed a plea challenging the nomination of TTV Dinkaraan, candidate of the AIADMK(Amma) faction.

When the plea came up for hearing before the first bench comprising Chief Justice Indira Banerjee and Justice M Sundar on noting that the plea had become infructuous in view of the order passed by the Election Commission on April 9 cancelling the election based on large scale bribing of voters by the AIADMK (Amma) party candidate.

However, the bench granted liberty to the petitioner to file a fresh petition as to the prayer seeking direction to the Governor of Tamil Nadu to invoke Article 356 in view of the illegalities committed by the ruling party. 

The petitioner Traffic Ramaswamy had cited various FERA violation against Dinakaran and illegalities resorted by them in the run up to the elections and sought for cancellation of his nomination.
