A division bench comprising Justice KK Sasidharan and Justice GR Swaminathan before whom the case came up, differed the hearing and directed the High Court registry to post the case before another bench sans Justice Swaminathan since as assistant solicitor general before becoming a judge, he had appeared in the case on behalf of the Centre. Originally, a Division Bench of Justices M.V. Muralidaran and C.V. Karthikeyan granted the interim stay on May 30 for four weeks.
Subsequently, another Bench of Justices A. Selvam and N. Authinathan extended it till July 6 as counsel representing the Centre sought time to file a counter affidavit. The petitioner S. Selvagomathy filed the PIL on grounds that PCA Act had permitted slaughter and sale of animals for slaughter and the Centre had no authority to extend its rule making power.
