Justice M Duraiswamy on Friday while recording the submission of the counsel appearing for the chairman, Manikandan, that he would appear before the court on Nov 13, without fail, directed the Registry to execute the warrant after Nov 14 and deferred the hearing to Nov 13. While passing orders on a writ petition from Franciscan Sisters of St Joseph, Justice Duraiswamy in August had directed the CWC chairman to restore the five kids to the home.
As this order was not obeyed, the petitioner filed a contempt application.
But thereafter, despite issue of statutory notice to Manikandan, he neither appeared nor adhered to the direction.
The CWC had removed the five children citing rules in the Juvenile Justice Act and sent them to a private home ignoring the pleas of the petitioner to transfer them to another home run by them.
