Passing orders on a plea moved by a batch of students, Justice N Kirubakaran, said, “The suffering of the students are due to various stake holders involved in establishment of the medical college. Therefore, all the stake holders should necessarily approach the matter with social responsibility to ensure that the order of this Court is complied with promptly and the students are accommodated in the Government Medical Colleges, at the earliest.”

Also, setting aside the Government contention that the Essentiality Certificate issued to the college had been withdrawn in 2012, the judge said “It is well-settled law that passing of an order is not enough, unless it is communicated to the opposite or affected parties. If the cancellation of Essentiality Certificate had come to the notice of MCI and Central Government, they would not have approved the establishment of the respondent College. Therefore, all the stake holders including the State Government have got responsibility towards the students.”

The judge in his order also set aside the contention of the Advocate General that only the meritorious have been given admission, whereas the first student who was admitted in the respondent Medical college has got 3090th rank and the last student admitted in the college has secured only 13830th rank and therefore, they cannot be accommodated along with the Government medical college students.

He said though, it is an admitted fact that students studying in the respondent college cannot be compared with those in the Government medical colleges, the difference between them vanishes once they get admission. Directing the Government to send a proposal to MCI to accommodate the students, within a week from the date of receipt of a copy of this order, the judge then directed the registry to call the matter for reporting compliance through video conferencing on January 02, 2018.
