Act against lawyer for aiding minor marriage, Bar Council told

Observing that ‘legal profession is not mentioned for conducting marriages,’ the Madras High Court has directed the Bar Council of Tamil Nadu and Puducherry to take appropriate action against an advocate, who manipulated records to show a person as major and got the marriage registered.

A division bench comprising Justice CT Selvam and Justice N Satish Kumar also directed the Inspector General of Registration to conduct necessary enquiry and take appropriate action legally against the sub-registrar, Poonamallee, for causally resorting to register the marriage without due and proper verification about the age of the boy and girl. 

As per the habeas corpus petition moved by the girl’s father, Mahalakshmi (19) was produced. Accompanied by one Micheal Vignesh, they informed the court that their marriage was registered by the sub-registrar, Poonamalle on January 22, 2018. In support of their contention that Micheal Vignesh was of marriageable age, they produced a photo copy of the record sheet ostensibly issued by the Principal, Government Adi Dravidar Welfare High School, Tiruvallur, reflecting his date of birth as June 7, 1995. 

But the counsel appearing for the girl’s father produced a copy of the transfer certificate issued by SA Polytechnic College, Chennai, which stated the date of birth as June 7, 1997. The parties involved after much probing conceded that Vignesh was actually a student of SA Polythechnic and that the entire documents produced before the court was prepared by their advocate E Lenin. 

However, the girl informed the court her firm intent not to go to her parental home and that she wishes to stay at a hostel in Chennai and pursue her studies.
