Civil suit to prevent use of biryani brand trade mark

A civil suit moved by Thalappakatti Naidu Ananda Vilas Biriyani Hotel, has led to the Madras High Court restraining ‘Dindigul Thalappakattu Restaurants’ located in Chennai-Tirupati by-pass, Narayanapuram and Tiruvallur district from using the name.

Justice CV Karthikeyan granted interim stay after ordering notice to Dindigul Thalappakattu Restaurant returnable by June 11. The plea had sought for a permanent injunction restraining Dindigul Thalappakattu restaurant from infringing the trade mark and trading style in any manner. 

Advocate S Vijayan who appeared for Thalappakatti Naidu Ananda Vilas Biriyani Hotel, submitted that the Deputy Registrar of Trade Marks has directed registration of the trade mark declaring it as ‘well known’ with a good reputation.
