Co-op polls: Madras HC tells parties to submit plaints
With the Supreme Court asking the Madras High Court to decide the pleas relating to the ongoing election process for numerous posts in over 18,000 cooperative societies in Tamil Nadu within a month, the MHC on Wednesday directed the aggrieved persons, including fresh complainants, to submit their applications/grievances/materials available with them, without any further delay.

Disposing a batch of writ petitions alleging large-scale irregularities in holding the elections, Justice SM Subramaniam said, “The State Election Commission on receipt of such complaints/applications/grievance petitions, shall consider the same and also offer personal hearing if requested, in a free, fair and transparent manner.”
“The State Election Commission shall apply its mind while considering the petitions and take a decision within 8 weeks from the date of receipt of such grievance petitions,” the
judge said.
Further, the judge in his order also held, “If a decision is taken in respect of any co-operative society, the State Election Commission is free to declare the results. After the declaration of results and disposal of the grievance petitions, if the party is still aggrieved, they can approach the authorities under section 90 (1) of the Tamil Nadu Co-operative Societies Act.”
“In the event of raising dispute under section 90 of the Act, the same shall be disposed of within 6 months, subject to the condition that the party to the dispute shall co-operate. If there is no co-operation, the authority is not bound by this direction,” Justice Subramaniam added.
Earlier, Additional advocate general PH Arvindh Pandian submitted that the authorities have acted swiftly on the complaints received and elections were conducted as per the procedure and a mere 412 grievance petitions were pending.
