The first bench comprising Chief Justice Indira Banerjee and Justice PT Asha before whom a PIL moved by K Gopinath, president, Hindu Munnetra Kazhagam in this regard came up said “It is not for this court to decide which organization should be banned and which organization might continue. That is in the realm of the executive of the State.”

The petitioner had contended that he had made a representation to the State and Centre on April 27, that

PFI has been formed to make up for the ban on SIMI (Students Islamic Movement of India) for its anti-social activities. But since there was no action on his plea, he had moved the court.

He further noted that PFI has been banned in Jharkhand and a case is pending in the High Court of Kerala where the Government of Kerala through its intelligence wing has presented sufficient materials to show the unlawful and anti-social activities of PFI.
