Sources said the legislators had decided to move the apex court following a split verdict passed by the first bench of the Madras High Court. “Their prayer includes transfer of the case to the SC as they fear they would not get impromptu justice from Madras HC. They have requested the apex court to transfer the case and hear it,” said a source.

Thangathamizhselvan, a trusted lieutenant of TTV, who has already announced that he would withdraw his petition challenging the disqualification orders is not part of the litigation moved in the apex court. He also said that he is deliberating with his legal advisors as to how to go about the withdrawal of his petition without affecting the MLAs.

“A decision on this would be taken within a few days”, he said.
