No relief for gutkha scam accused

The Madras High Court on Tuesday refused to grant any relief on a bail application moved by Senthil Murugan, Health Inspector, who had reportedly received a bribe of over Rs 2 lakh every month during 2013-15 from illegal gutkha manufacturers.

Justice V Parthiban before whom the plea came up on noting that the allegations against him was grave adjourned the bail application to October 22 for further hearing.

Also, pointing out to the CBI counsel’s submission that none of the six accused arrested so far have been granted bail by trial court so far, the judge said if the present application is allowed the other accused might take advantage of the order.

During the hearing, senior counsel Ragunathan representing Senthil Murugan submitted that he was just a licensing authority and that the licence to manufacture pan masala was given with a clear instruction not to use nicotine substances.

If the terms of license are violated by the manufacturer, the licensing authority cannot be held liable for the same, he contended.

Opposing the application, CBI counsel Srinivasan contended granting bail to the petitioner who was a public servant would definitely hinder the investigation.

Asserting that CBI has sufficient materials and evidence to prove that he was receiving Rs 2.50 Lakh as bribe every month during 2013-2015, Srinivasan submitted that the trial court has rightly denied bail not only to the petitioner but to all the other five accused.

He further submitted that the CBI should be given adequate time to file a reply to the bail application.
