‘Confine to confiscating only 14 listed plastics’
While cautioning officials against indiscriminate seizure of plastic products based on the plastic ban, the Madras High Court on Thursday directed government officials not to seize plastic products other than the 14 items listed in the June 25, 2018 Government Order (GO) banning use of single use plastic products since January 1.

A division bench comprising Justice MM Sundresh and Justice Krishnan Ramasamy passed the interim order on a batch of pleas moved by retail traders of plastic products alleging harassment by authorities in the guise of implementing the ban order.
The petitioners had submitted that the officials, without understanding the prohibition’s scope, were seizing plastic products which were not banned by the GO. They alleged that the officials who conduct inspections were seizing all plastic products irrespective of whether they were banned by the GO or not.
Also, reiterating that lack of clarity amidst officials on the GO has resulted in the confiscation of all plastic items which are not listed in the annexure of the June 25 GO, the plea wanted the court to restrain the authorities from doing so and direct them to seize only the 14 listed products.
However, to the suggestion made by a different division bench to the court to the government to consider banning all plastic products in a phased manner, the petitioners informed the court that they had moved a review petition seeking to review the court’s suggestion.
Recording the same and noting that except the 14 items listed in the GO, other plastic items should not be seized, the bench posted the plea to January 23 for further hearing.
