Hosur seat notified as vacant

The state Legislative Assembly Secretariat on Tuesday notified the Hosur Assembly seat as vacant, following the resignation of former Minister P Balakrishna Reddy following his conviction in a stone pelting case.

Reddy resigned as Minister as he was automatically disqualified following his three year conviction in the case.

Though the court has suspended his sentence, his conviction was not stayed, following which he ceased to be a Member of the Assembly.

The notification, announcing the Hosur seat as vacant, comes in the backdrop of demands from various Opposition parties, including the DMK, which had also petitioned the Governor seeking a direction to the Speaker to make an announcement to this effect so that bypolls could be held along with the Lok Sabha elections.

Assembly Secretary K Srinivasan, said,  in the wake of a Special Court trying cases against MPs  and MLAs convicting Reddy, the latter lost his post under Section 8 (3) of the Representative of People’s Act, 1951, and under Article 191(1)(c) of Constitution.  On Tuesday it was notified in the Gazette that the seat was declared vacant with effect from January 7, this year, he added.
