‘Declare corrupt public servants anti-nationals’- Madras High Court

Lamenting that every person in India was facing corruption from their birth to death, the Madras High Court drew a parallel between corruption and terrorism and sought to declare corrupt public servants, including officials, legislators and members of the judiciary, as ‘anti-nationals’ for obstructing the country’s development.

Passing orders on a plea moved by a Village Administrative Officer seeking to set aside his suspension on corruption charges, Justice S M Subramaniam noted that corruption was the obstacle for the development of the country, and wondered how should such officials be described. “Certainly, such persons are anti-nationals. Terrorists are declared as anti-social elements. Thus, persons corrupt and acting against the developmental activities of our nation are also to be declared as anti-nationals.”


The judge noted that bribing the public authorities has become a way of life for many people. Justice Subramaniam did not spare judiciary, too, adding that judicial corruption was the greatest enemy to the Constitution. Judiciary must initiate drastic measures to control corruption in various forms, the judge said.


Also, observing that it was painful to state that sexual favours were demanded in lieu of bribe in educational institutions and public offices, Justice Subramaniam said, “Recently, popular corruption is ‘vote for cash’. Our nation had large number of statesmen. However, in present days, the concept of ‘vote for cash’ is being developed by many political parties.”


“These representatives of people are not only accountable but also responsible for enactment of laws. If they indulge in such corrupt activities of ‘vote for cash’, then the very foundation of the democratic principles is shaken. It is undoubtedly a slam on democracy. Equally, few voters fail to realise the sanctity and the value of the right of voting,” the judge noted in his order.


He also pointed out that the non-corrupt and right-thinking persons, who were in a minority now, should necessarily be encouraged and protected by the Constitutional Courts and the authorities competent to ensure that fight against the corrupt majority was advanced.


“This court is of the fond hope that the minority non-corrupt will certainly win the battle against the corruption, if the spirit of democracy and constitutional principles are advanced and implemented amongst the youth of this nation,” Justice Subramaniam added.
