Fresh report on injuries of Martin’s accountant sought

Trashing the police report regarding the death of Palanisamy, the cashier of lottery baron Santiago Martin, as devoid of details, the Madras High Court has directed the police to file a fresh report on Thursday providing specific details about the external injuries found in the victim’s body being either ante-mortem or post-mortem and the manner in which his body has been preserved.

SA division bench comprising Justice C V Karthikeyan and Justice Krishnan Ramasamy made this observation after perusing the Status report and post-mortem report submitted based on a plea moved by the victim’s son, Rohin Kumar, seeking CB-CID enquiry into the death of his father.

“Two injuries are found. But no specific opinion is given whether it is ante-mortem or post-mortem. Specific report has to be given expressing opinion regarding the said injuries,” the bench said.

Further, during the hearing, counsel Sankarasubbu appearing for the petitioner submitted that despite the court’s direction to preserve the victim’s body, the same has been kept in the open resulting in it getting decomposed.

Based on this, the bench directed the investigating officer to file a report regarding the preservation of Palanisamy’s body. Also, the bench on directing the police to submit the status report, directed the petitioner as well as the Additional Public Prosecutor (APP) to address the court on the scope of invoking Section 176, which deals with inquiry by Magistrate into the cause of death. The bench further directed the APP to give a timeline about the receipt of Forensic Report and Chemical Analysis report with regard to the above matter.

The petitioner, Rohin, had submitted that I-T officials raided their house and interrogated his father from April 30. Thereafter, he was asked to come for interrogation to Martin’s office at 7 a.m. on May 3. But the same day, the police claimed that he committed suicide by drowning in a lake.

Alleging that his father was tortured by the team who conducted the raid, the petitioner said that the office boy at Martin’s office clarified that he did not turn up at Martin’s office while Martin’s advocate informed that Palanisamy was at the Karamadai Police Station. But soon after, the suicide theory was floated and when he went to the Mettupalayam Government Hospital, he saw his father dead with bleeding injuries on his face and head.
