HC initiates suo motu proceedings against illegal groundwater tapping as directions ignored
Taking strong exception to the Tamil Nadu Government failing to implement its direction of registering theft cases against illegal extraction of groundwater, the Madras High Court on Friday initiated suo motu contempt proceedings against the State for allowing a few individuals to commit such illegalities in violation of the judgment as well as the constitutional principles.

Justice S M Subramaniam taking cognisance of a media report relating to groundwater being stolen by a few individuals and being sold to the public for huge amounts ranging from Rs 4,000 to Rs 5, 000 for 6,000 litres, said “If water is sold for an exorbitant price, it may not be possible for the common man to lead a peaceful life. Thus, it is duty mandatory on the part of the State to ensure supply of water by regulating the same by avoiding illegal extraction for the purpose of selling the water for exorbitant price.”
Also, recalling his earlier order which had categorically held that mines, minerals and water beneath the earth are national properties and no individual has any right to extract water without permission from competent authorities, Justice Subramaniam, said, “Despite specific directions issued by this Court and complaints filed by the public and the broadcasting of theft of water, the selling of potable water for exorbitant price are neither even looked into nor suitable actions taken by the competent authorities of the State.”
Raising a volley of questions on the actions initiated by the State to regulate the extraction of groundwater in Government and private properties, the judge set the contempt of court rolling seeking an explanation from PWD and TNPCB as to why they should not be punished for committing willful disobedience of the court’s order. Justice Subramaniam, while directing the registry to serve notice to the Advocate General through a special messenger, also sought it to list the matter for hearing on May 20.
