Ensure OBC quota in seats surrendered by TN to Centre: MP

DMK, Member of Parliament (Rajya Sabha) P Wilson has urged the Union Health Minister Harsh Vardhan to constitute a high level committee to investigate the failure by Medical Council of India (MCI), Director General of Health Services (DGHS) and Medical Counselling Committee (MCC) to implement OBC reservations in the State surrendered seats for All India Quota.

Wilson in a letter to the Health Minister stated that the State of Tamil Nadu has already brough forth a special enactment in 1994, which offered 30% reservation to Backward Classes, 20 % to Most Backward Classes and denotified communities-20%, 18 % to Scheduled Castes and one percent to Scheduled Tribes. This applies to all educational institutions in Tamil Nadu (except Central Government Institutions), which includes the seats surrendered by the State to All India Quota.

Hence, failure to implement the1994 Act and OBC reservations in the State surrendered seats to All India Quota all along by MCI and DGHS through medical counselling and framing brochure of NEET through National Testing Agency is nothing but grave injustice to the OBC students across the country, the Rajya Sabha MP and senior counsel, Madras High Court said.

He further noted that despite the existence of the 1994 Act, the DGHS, MCC and MCI with impunity have flouted the implementation of respective State laws relating to reservation and have put the OBC students to untold hardships and misery by depriving them of their lawful reservations since NEET’s implementation.

“The injustice is done not only to the OBC students who are pursuing their medical career in Tamil Nadu but all over India. Such a grave violation to give effect to lawful reservation affects the constitutional guarantee to the OBC students,” Wilson added.

He also sought the health minister to direct the appropriate authorities viz MCI, DGHS and Central Medical Counselling committee to apply state reservation as per the Act 1994 and implement in true letter and spirit the 50 per cent reservations for OBC students and 69 per cent reservations for BC/MBC, SC and ST in UG, Diploma and PG medical courses in the state surrendered seats to the All Indian Quota in non-Central Government institutions viz State government and private medical colleges in Tamil Nadu from the academic year 2020-21 onwards.
