Insurance firm told to pay Rs 18.8 L in mishap claim case
Four years after a 23-year-old woman met with a fatal accident, the Motor Accidents Claims Tribunal (MCAT) has ordered the ICIC Lombard General Insurance Co Ltd, to pay Rs 18.8 lakh to the kin of the deceased.

The petition was filed by one V Vasuki after her daughter V Maheswari died in a road accident near Mathur on May 10, 2016, under section 166 of the Motor Vehicles Act and Rule 3 of MACT claiming compensation of Rs 29 lakh.
Vasuki submitted that her daughter was standing in Mathur bus stop on Sriperumbudur road when the accident occurred. “Maheshwari was hit by a mini truck sustaining multiple head injuries around 7 pm on the said day. She was taken to Rajiv Gandhi Government General Hospital where she succumbed to injuries on the following day,” the petition read.
Vasuki contended that the mini-truck was driven by its driver A Jothish in a rash and negligent manner endangering public safety and hit her daughter.
Countering this, the insurance firm denied all the allegations contained in the petition including the manner of the accident and fatal injuries sustained by the deceased. “This accident took place due to the negligence of the deceased hence the petitioner cannot maintain this application,” the firm submitted.
Recording the submissions, Judge S Umamaheswari said, “This tribunal concludes that the accident had happened due to rash and negligent driving by the driver of a mini truck. Therefore, being the insurer of the vehicle, the firm is directed to pay the petitioners a sum of Rs 18,88,000 with future interest at 7.5 per cent per annum from the date of the numbering of the petition which is June 29, 2016.”
